The court of appeal in Owerri on Thursday, November 7, 2019 upheld the electoral victory of Senator Rochas Okorocha, of Imo West senatorial district.
In a judgement read by Justice R.A Ada, who is the chairman of the appeal panel on the appeal filed by Senator Osita Izunaso of the All Progressives Grand Alliance and Jones Onyereri of the Peoples Democratic Party against Senator Okorocha, the appeal court panel declared that the appeal lacked merit.
According to the judge, the judgment of the lower court (Tribunal) which upheld Senator Okorocha’s election was in order.
The panel said that the petitioners could not prove their allegations of violence, over-voting, mutilation of electoral results and hijacking of electoral officers.
They said that the petitioners could not prove the allegation of duress as the returning officer alleged.
Senator Okorocha had on February 23, 2019 defeated Onyereri and Izunaso but the returning officer alleged that he declared Senator Okorocha winner under duress.
